Part 1 — Introduction & Accounts

1. Introduction

Welcome to GetSurf.

These Terms of Service (the “Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and EVILTEC LLC, a Wyoming limited liability company (“GetSurf,” “we,” “our,” or “us”), governing your access to and use of the GetSurf website, platform, applications, APIs, software, services, features, content, and related functionality (collectively, the “Platform”).

By accessing, browsing, registering for, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and all policies incorporated into or referenced by these Terms.

If you do not agree to these Terms, you must not access or use the Platform.

2. Purpose and Role of the Platform

GetSurf operates as an online discovery and lead-generation platform that helps individuals seeking surf instruction connect with independent surf instructors.

GetSurf does not itself provide surf lessons, employ surf instructors, operate as a surf school, act as a travel agency or tour operator, organize guided tours, act as a booking agent, guarantee Instructor availability, guarantee the quality or outcome of any lesson, guarantee Customer attendance, or act as an insurer, certifying body, or safety organization.

The Platform is intended solely to facilitate introductions and communications between Customers and independent Instructors.

Any agreement concerning a surf lesson or related service—including scheduling, pricing, payment, meeting location, cancellation, equipment, transportation, insurance, supervision, physical requirements, ocean conditions, or safety procedures—is entered into directly between the Customer and the Instructor.

GetSurf is not a party to any agreement between a Customer and an Instructor and does not control the conduct of either party.

3. Acceptance of These Terms

By creating an account, purchasing Credits, submitting an inquiry, unlocking or receiving a Lead, contacting another User, or otherwise using any part of the Platform, you represent and warrant that:

• you have the legal capacity to enter into a binding agreement;

• you are at least thirteen (13) years old;

• if you are under the age of majority in your jurisdiction, you are using the Platform only with the consent and supervision of a parent or legal guardian;

• all information you provide is accurate, complete, current, and not misleading;

• you will comply with these Terms and all applicable laws and regulations; and

• you are not prohibited from accessing or using the Platform under any applicable law.

If you access or use the Platform on behalf of a company, surf school, organization, partnership, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms. In that case, “you” and “your” refer to both you and the entity.

4. Definitions

For purposes of these Terms, the following definitions apply:

“Customer” means a natural person who uses the Platform to discover, contact, inquire about, or arrange surf instruction with an independent Instructor.

“Instructor” means an independent individual or business that offers surf instruction or related services and uses the Platform to receive or unlock Leads, maintain a profile, or communicate with Customers. Instructors are independent service providers and are not employees, agents, representatives, franchisees, partners, joint venturers, or contractors of GetSurf.

“Lead” means a Customer inquiry made available or transmitted through the Platform to one or more eligible Instructors. A Lead may include, where applicable, a Customer’s first name, WhatsApp contact information, preferred surf location, requested lesson type, experience level, requested date, number of participants, and additional information voluntarily submitted by the Customer. A Lead does not guarantee that a lesson, booking, transaction, or communication will occur.

“Credits” means virtual, non-transferable digital units purchased or otherwise granted to an Instructor and redeemable only for eligible Platform functionality, including unlocking Leads. Credits have no cash value and do not constitute stored value, electronic money, a bank deposit, a gift card, a security, a financial instrument, or ownership interest in GetSurf.

“Content” means any information, photographs, videos, reviews, text, logos, graphics, comments, ratings, messages, files, software, data, or other materials made available on or through the Platform.

“User Content” means Content uploaded, submitted, posted, transmitted, displayed, or otherwise provided by a User through the Platform.

“Platform” means the GetSurf website, applications, software, APIs, databases, dashboards, administrative tools, communication systems, and related services and functionality.

“Services” means the functionality made available through the Platform, including instructor discovery, lead generation and delivery, Instructor profiles, Customer inquiries, communications, payment processing for Credits, account management, ratings, and related functionality.

“Third-Party Services” means websites, software, platforms, payment processors, messaging providers, analytics providers, map providers, identity-verification services, or other services operated by third parties and integrated with or linked from the Platform.

Certain Platform features require an account.

When creating or maintaining an account, you agree to:

• provide truthful, accurate, complete, and current information;

• promptly update information that becomes inaccurate or outdated;

• maintain only one personal account unless GetSurf expressly authorizes otherwise;

8. Account Security

You are responsible for safeguarding your login credentials, devices, authentication methods, and account access.

You agree to:

• use a reasonably secure password or authentication method;

• maintain appropriate security on devices used to access the Platform;

• not disclose login credentials to unauthorized persons;

• immediately notify GetSurf of suspected unauthorized access, account compromise, or security incidents; and

• cooperate with reasonable security measures requested by GetSurf.

GetSurf is not responsible for losses arising from your failure to protect your account, credentials, devices, or authentication methods, except where such responsibility cannot lawfully be excluded.

9. Verification and Platform Integrity

To maintain Platform integrity, reduce fraud, and improve Lead quality, GetSurf may verify certain information provided by Users.

Verification methods may include:

• email verification;

• WhatsApp or telephone-number verification;

• SMS verification;

• CAPTCHA or reCAPTCHA verification;

• payment-method verification;

• automated fraud-detection tools;

• automated risk scoring;

• device, network, or location signals;

• sanctions or compliance screening; and

• manual account or profile review.

GetSurf may use WhatsApp-related tools or services to validate whether a telephone number appears capable of receiving WhatsApp communications. Such validation is intended to reduce obvious errors or abuse, but it does not guarantee that the number belongs to the named Customer, that the Customer will respond, or that a lesson will occur.

Verification does not constitute an endorsement, certification, guarantee, warranty, background check, or representation regarding any User’s identity, qualifications, safety, reliability, legality, or suitability.

Users remain solely responsible for evaluating one another and for making independent decisions before arranging or participating in any surf lesson or related service.
